A. Richard, excellent question and it maybe my most asked question. The easy answer is NO. You have to list all your assets and creditors. Failure to do this is Bankruptcy Fraud.

A. Carleen, the quick answer is maybe.If you are able to demonstrate a change of circumstances from your prior case, demonstrated good faith, and there are no other limitations from the court, you can file a Motion to Extend with your bankruptcy petition. This special motion will, if approved, will allow you to continue with your second case with the full protections of the bankruptcy court.


Q. How long do you have to wait to file a Chapter 7 if you filed a prior one? John from Batesburg

Q. Do I have to disclose to the Court everything I own?  What happens if I fail to disclose property?  Glen from Columbia

A. Glen, the easy answer is YES. Failure to list all legal and equitable interest in property is a Federal crime. Besides, having your case dismissed, you could also be charged with a crime
